About the terms

1. By using mocoproject.org.uk you agree to be bound by these terms, which shall take effect immediately on your first use of mocoproject.org.uk. If you do not agree to be bound by all of the following terms please do not contribute to mocoproject.org.uk

2. The MOCO Project may change these terms from time to time and so you should check these terms regularly. Your continued use of mocoproject.org.uk will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using this website.

Use of mocoproject.org.uk

3. You agree to use mocoproject.org.uk only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of mocoproject.org.uk. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content to mocoproject.org.uk. 

Contributions to the MOCO Project

4. By sharing any contribution (including any text, photographs, graphics, video or audio) with the MOCO Project you agree to grant to the MOCO Project, the Mass Observation Archive, and any future partner or individual that the MOA deems appropriate, free of charge permission to use the material in any way it deems fit. This includes educational, research, promotional uses, for both commercial and non-commercial purposes. Usage of the MOCO archive will be subject to the approval by the Board of Trustees of the Mass Observation Archive, a registered charity.

5. Giving consent does not represent a transfer of ownership of rights from creators or contributors.  You still own the copyright in your contribution.  However, in addition to the aforementioned rights granted to the MOCO Project and the Mass Observation Archive, you also agree to license your contributions to any other user under the following conditions:  Your agree that your contributions are made available to be shared (copied, distributed, transmitted) as long as the user attributes the work in the manner specified within the MOCO Terms and Conditions, the work is used for Non-Commercial purposes and the work is not altered or transformed.

6. In order that the MOCO Project can use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any UK laws, that you have the right to give the MOCO Project permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16.

7. The MOCO Project will NOT use or show your name in any context, unless you have given your full consent for the MOCO Project to do so. The MOCO Project retains the right to contact you for administrative or verification purposes in relation to your contribution.

8. Please do not endanger yourself or others, take any unnecessary risks or break any laws when creating content you may share with the mocoproject.org.uk.

9. If you do not want to grant the MOCO Project the permission set out above on these terms, please do not submit or share your contribution to or with mocoproject.org.uk.

 (i) About your posts:

  • Contributions must be civil and tasteful.

  • No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.

  • No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.

  • No advertising or promoting.

  • No impersonation.

 (ii) Safety:

We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, postal address, home address or email address or any other details that would allow you to be personally identified) in any mocoproject.org.uk submissions.

(iii) Legal requirements:

  • You may not submit or share any defamatory or illegal material of any nature in mocoproject.org.uk. This includes text, graphics, video, programs or audio.
  • Contributing material to mocoproject.org.uk with the intention of committing or promoting an illegal act is strictly prohibited.
  • You agree to submit to or share with mocoproject.org.uk only contributions which are your own original work. You must not violate, plagiarise, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

(iv) If you're under 16:

  • Please get a parent's or guardian's permission before taking part in mocoproject.org.uk
  • Never reveal any personal information about yourself or anyone else (for example, school, telephone number, your full name, home address or email address).

(v) If you breach these rules:

If you fail to abide by these rules when taking part in the MOCO Project, you will be sent an email which informs you why your contribution has been refused or edited. Any inappropriate content will be rejected or taken down by the MOCO Project. If in doubt, please do not share your content with the MOCO Project.

Terms of Usage

11. Anyone is entitled to use the material for Educational Purposes (means for the purpose of education, teaching, distance learning, private study and/or research) but not for Commercial Purposes (i.e. selling or reselling the material or using it for any commercial gain), with the exception for the Humprey Spender Bolton photographs, which may not be used at all. The appropriate citation notifications (see below) must accompany any usage.  Users may:

  • copy items and save them;
  • print the items;
  • excerpt, annotate, and aggregrate the items;
  • use the items in virtual learning environments, managed learning environments and in any material to be used in the course of instruction. Course and study packs in non-electronic non-print perceptible form, such as Braille, may also be created;
  • distribute, communicate and make available the items, to the public in any form and in any media whether now known or hereafter created as long as it is for educational non-commercial purposes;

12. The names, marks and logos identifying the MOCO Project, or third parties are proprietary marks of these organisations and may not be reproduced without their prior written permission.

Citation

13. At all times,

  • when using Mass Observation Communities Online material you must include the statement 'This item is from The Mass Observation Communities Online Archive (c) the Mass Observation Archive Trustees/"Insert name of community group".'

  • when referring to original Mass Observation material you must include the following copyright notice: 'Mass Observation material (c) Trustees of the Mass Observation Archive.'

Disclaimers and Limitation of Liability

14. The majority of content posted in mocoproject.org.uk is created by members of the public. The views expressed are theirs and unless specifically stated are not those of the MOCO Project, the Mass Observation Archive, the University of Sussex, JISC or any of the MOCO Project Community Partners. 

General

15. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

16. The failure or delay of the MOCO Project to exercise or enforce any right in these terms does not waive the MOCO Project’s right to enforce that right.

17. These terms shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
